Plain English summary
- These terms are agreed by a parent/guardian or school — not by the child.
- We collect a child's name, month and year of birth, username and password. Month and year of birth is used only to determine year group and age-appropriate content. We do not collect email addresses or photos from children.
- Performance data (spelling & typing) is processed locally unless you opt in to anonymous AI analysis.
- Children are never exposed to other users or external content.
- There are no in-app purchases. Subscriptions are managed directly with us.
- All content (images, audio, etc.) belongs to us and may only be used within Spello.
1. About us
Viaduct Industries Limited ("we", "us", "our") is a company registered in England and Wales, with our registered office at 3rd Floor, 86–90 Paul Street, London, EC2A 4NE. We operate Spello (the "Platform"), a children's educational spelling and typing application available via web browser and as a free iPad app.
By creating an account or accessing the Platform, the account holder confirms they have read, understood and agree to these Terms & Conditions ("Terms").
2. Who these terms apply to
These Terms are between us and the account holder — either a parent or guardian ("Parent Account") or a school or educational institution ("School Account"). Children use the Platform through an account created and managed by an adult on their behalf.
By accepting these Terms, you confirm that:
- if you are a parent or guardian, you have the authority to agree to these Terms on behalf of any child whose account you create; or
- if you are acting on behalf of a school, you have the authority to bind that organisation to these Terms.
Children do not manage their own accounts and are not required to agree to these Terms directly.
3. Accounts
3.1 Setting up a child's account
Accounts for children are created by a parent or school. When doing so, you will provide:
- a name for the child;
- the child's month and year of birth (used solely to determine year group and deliver age-appropriate content — we do not store the day of birth);
- a username chosen by you; and
- a password chosen by you.
We do not require any further personal information about the child to create an account.
3.2 Account security
You are responsible for keeping login credentials secure. If you believe an account has been compromised, please contact us immediately at hello@spello.uk.
3.3 School-linked parent accounts
Where a school holds a School Account and enrols a child, a parent may also create a separate Parent Account linked to that child. This gives the parent access to basic progress information. Parents wishing to access more detailed analytics and AI-assisted guidance may upgrade their account (see Section 5).
4. Acceptable use
The Platform is provided for personal, non-commercial, educational use only. You agree not to:
- use the Platform for any unlawful purpose;
- attempt to access another user's account;
- reverse-engineer, decompile or attempt to extract source code from the Platform;
- reproduce, distribute or make available any content from the Platform outside the Platform (see Section 8); or
- use automated tools, bots or scrapers to access the Platform.
Children are not exposed to other users, public forums or external content through the Platform.
5. Subscriptions & pricing
5.1 Plans
We offer subscription plans for parents and guardians, and for schools and educational institutions. A free tier with limited access may also be available. Current pricing and a full description of what each plan includes can be found on our pricing page at spello.uk/pricing.
In general terms:
- Parent subscriptions cover a set number of children and provide unlimited access to Platform features, including detailed analytics and AI-assisted guidance where opted into.
- School subscriptions cover unlimited children and teachers within the subscribing school. Parents of enrolled children may create a free linked account to view basic progress information, or upgrade to a paid Parent subscription for access to full analytics.
5.2 Payment
Payments are processed securely by Stripe. We do not store your payment card details. All prices are inclusive of VAT where applicable.
5.3 Renewal & cancellation
Subscriptions renew automatically at the end of each billing period unless cancelled before the renewal date. You may cancel at any time through your account settings or by contacting us at hello@spello.uk. We do not provide refunds for partially used subscription periods, except where required by law.
5.4 Price changes
We may change our subscription prices from time to time. We will give you at least 30 days' written notice of any price increase before it applies to your renewal. If you do not wish to continue at the new price, you may cancel before the renewal date.
6. Data & privacy
We are the data controller and data processor for personal data collected through the Platform. We comply with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Our full Privacy Policy is available at spello.uk/privacy.
6.1 What we collect

We do not collect children's email addresses, full dates of birth, photographs, location data or any social identifiers.
By collecting only month and year of birth rather than a full date of birth, we deliberately limit the identifiability of the data we hold about children in line with the principle of data minimisation.
6.2 Legal basis for processing
- Contract performance — to provide the Platform and subscription services, including determining year group from month and year of birth.
- Legitimate interests — to improve the Platform, ensure security, and prevent misuse.
- Consent — where you opt in to AI-assisted analysis (see Section 7).
6.3 How we use data
- Providing and maintaining the Platform;
- determining a child's year group and delivering age-appropriate content based on their month and year of birth;
- tracking and displaying a child's spelling and typing progress;
- generating personalised learning recommendations;
- processing subscription payments;
- communicating with account holders about their account; and
- complying with legal obligations.
6.4 Data storage & security
Performance data is processed locally on your device by default. Where data is transmitted to our servers, it is protected using industry-standard encryption (TLS). Our infrastructure is provided by Krystal Hosting Ltd and protected via Cloudflare's security and content delivery network.
6.5 Third-party processors
- Stripe — payment processing;
- Cloudflare, Inc. — security, DDoS protection and content delivery;
- Krystal Hosting Ltd — web hosting and infrastructure; and
- Brevo (Sendinblue SAS) — transactional email delivery (account notifications, contact form replies and similar service emails); and
- BunnyWay d.o.o. (BunnyCDN) — content delivery for static game assets (no personal data is sent).
We do not sell personal data or share it for advertising purposes.
6.6 Data retention
We retain account and performance data for as long as your account is active, plus a reasonable period thereafter to comply with legal obligations. You may request deletion at any time (see Section 6.7).
6.7 Your rights
Under UK GDPR, you have the right to: access data we hold; correct inaccurate data; request erasure; restrict processing; data portability; object to certain processing; and withdraw consent at any time where processing is consent-based.
To exercise any right, contact us at hello@spello.uk. We will respond within one calendar month. You also have the right to complain to the Information Commissioner's Office (ICO) at ico.org.uk.
7. Optional AI-assisted analysis
By default, a child's performance data is stored only on your device and our secure servers, and is not shared with any external AI service.
If you choose to enable AI-assisted analysis, you consent to anonymised performance data being shared with an AI service to generate additional personalised guidance. When enabled:
- data is anonymised before transmission — no name, month/year of birth, username or account identifier is included;
- the AI service processes the data solely to generate recommendations, and does not retain it for other purposes; and
- you may withdraw consent and disable this feature at any time in your account settings.
This feature is entirely optional. Spello remains fully functional without it.
8. Intellectual property
All content on the Platform — including but not limited to text, images, illustrations, audio files, sounds and software — is owned by Viaduct Industries Limited or licensed to us and is protected by copyright and other intellectual property laws.
You may not copy, reproduce, distribute, publish, display or create derivative works from any content from the Platform outside of the Platform itself. In particular, our images, illustrations and audio files may not be used in any other application, tool, website or publication without our prior written permission.
Nothing in these Terms transfers any intellectual property rights to you.
9. Liability
9.1 What we do not exclude
Nothing in these Terms limits or excludes our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any liability that cannot be excluded or limited under English law.
9.2 What we do exclude
To the fullest extent permitted by law, we exclude liability for:
- loss of data, revenue or profits arising from your use of the Platform;
- any indirect or consequential loss;
- interruptions to the Platform caused by events outside our reasonable control (including third-party provider outages); and
- the accuracy of AI-generated recommendations, which are provided for guidance only and do not constitute professional educational advice.
9.3 Platform availability
We aim to keep the Platform available but do not guarantee uninterrupted access. We may suspend or withdraw the Platform for maintenance or operational reasons, with notice where reasonably practicable.
10. Changes to these terms
We may update these Terms from time to time. We will notify account holders of material changes by email or by a prominent notice within the Platform, at least 14 days before the changes take effect. Your continued use of the Platform after that date constitutes acceptance of the updated Terms.
If you do not agree to the updated Terms, you may cancel your account before the changes take effect.
11. Governing law & complaints
These Terms are governed by the laws of England and Wales. Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
